It is one of the most common misunderstandings among small businesses in Kent. You have a van, you have some waste, so why not run it down to the tip? The answer is that you cannot, and getting this wrong can be expensive. Here is the situation in plain terms.
The tip does not take business waste
Household waste recycling centres exist for household waste. Kent County Council is explicit that you cannot bring business waste to its sites, including the Folkestone centre. It does not matter that the waste looks like household rubbish, or that it fits in your car. If it came from your business, it is business waste, and the tip is not the route for it.
This catches out shops, salons, cafes, landlords, tradespeople and small offices all the time.
Your duty of care is stricter than a householder's
Every business that produces waste has a legal duty of care for it. In practice that means:
- Only passing your waste to an authorised, licensed waste carrier
- Checking that carrier is genuinely registered, not just taking their word for it
- Keeping documentation, such as waste transfer notes, as your record
Crucially, paying someone else to take it away does not transfer the responsibility off you. If your waste ends up fly tipped, it can still come back to your business.
The penalties are not trivial
Folkestone and Hythe District Council can issue Fixed Penalty Notices of up to £1,000 for fly tipping, and it has confirmed that those who fail to meet their duty of care when paying someone to dispose of their waste face increased sanctions. For a small business, that is a painful and entirely avoidable cost, on top of the reputational damage.

What to do instead
The compliant route is straightforward. Use a licensed waste carrier who collects from your premises and gives you the paperwork. Depending on your business, that might be:
